The French Registry of Commerce and Companies

The French Registry of Commerce and Companies, or the Registre de commerce et des sociétés (RCS) includes all natural and legal persons engaged in commercial activities, and other entities according to the Act of December 19, 2002 on non profit foundations, civil society etc. The Trade Registry in France operates under the authority of the Minister of Justice and its management is entrusted to the economic interest group comprising RCSL, State Chamber of Commerce and the Chamber of Trade.

The Companies House in France gathers information of individuals and legal entities. For individuals, the French Company Registrar includes information about their full name, address, date and place of birth, nationality, property and for legal entities, company name, social capital, registered office, duration, date of incorporation, governing bodies etc. Anyone can obtain this information through special request, and can ask for copies, excerpts, or certificates registered in the database.

Registering a company within the French Trade Register is done by submitting an application form at the trade register in the Commercial Court. Since February 1, 2005 the principle of electronic company registration was implemented under Decree No. 2005-77. This enables a simpler registration procedure. The institution issues an incorporation certificate in maximum four days since submitting the application forms.

Besides registration, The French Company Registrar offers the possibility to search through companies, to find specific information like Memorandum of association and certificates, balance sheets, collective actions and other information and it is obliged under law to issue excerpts and authorized copies of certain documents and to provide information requested by individuals. Also the Trade Register registers information like changing headquarters of a company, changing the management group, or director boards, cession of shares, shareholders information etc. The institution verifies the entity's documents, then analyzes the request and in a matter of days, gives an approval or solicits more information.

The French Registry of Commerce and Companies has representatives all over France, is in charge of regulating incorporation procedures and providing valuable information about all registered French companies.
