Register a Non Profit Organization in France

The French associations are forms of non-profit organization settled in France under the “Association Loi 1901”.

The association created in France may be declared or non-declared, this affecting the way of operating. For example, a non-registered association opened in France cannot open a bank account, collect membership fees or undertake any commercial actions (like buying or selling).


 An association established in France is a convention between two or several persons gathered under different goal that the one of making profit for them.

According to the law, anyone is free to join an association setup in France and may withdraw at any moment after paying the specific liabilities.

In order to gain legal status, an association formed in France must be declared in the first phase at the prefecture or sub-prefecture where it has its main seat. In order to do that, the following information must be revealed: the name, the objectives and details regarding its members in charge with administration (nationality, name, profession), a copy of the standard statute, certified and dated by the founders or by at least two members (forms of the statute may be found at the Prefecture).

In some cases, the language that will be used in communication (if different from French) must be stated and also the term of association (most of the times is “unlimited”)

The process takes about five days and it’s free of charge. The creation of the association must be stated in the “Journal Officiel”, no longer than a month from the declaration at the Prefecture.

Any changes that may occur in its status must be declared no longer than three months. These modifications are included in a special register, available any time for the administrative and legal authorities.

Usually, an association created in France is not subject to taxation, but in certain cases taxes may be required for example when the annual turnover exceeds 76,224 €, if the VAT of its turnover exceeds 76,224 € for the sale of goods, provision of food or shelter, or 26,680 € for all other service activities.

If the association opened in France will have employees, it’s advisable to register at the “Cheque Emploi Associatif”, a service which allows the association to pay the social security, the pension fund and unemployment contributions at a single agency.

Exceptions are the associations located in the Alsace-Moselle. Here, the associations must be created by at least seven members, can make profit as long are not considered direct competition to the domestic enterprises and may be forced to pay business tax. The declaration of the associations here must be made at the magistrate court and the local newspaper must announce it.

The dissolution of an association opened in France may be voluntary, legal or administrative and may be instituted if the goals are no longer pursued, if an illegality was produced by the association, if the members decides so or if the County Court takes this decision.

Some entrepreneurs choose this type of entity before establishing an enterprise with the same activities in order to test the market but must make sure that this won’t cost them the same as a regular business.
