The Russian public notary plays an important role in the legal system. The history of public notaries in Russia states that at first there were clerks who used to help people make contracts. Later, the notaries in Russia began to be named like that. A Russian law adopted in February 1993 regulates the activities of a public notary in Russia, as well as some references in the Civil Code. A Russian notary can work in a public office, or he can be involved in private practice. Public notaries in Russia work on behalf of the state and are authorized by the state. There are several Chambers of Notaries who supervise the activity of public notaries in Russia and all local Chambers form the Federal Notary Chamber. If a Russian notary violates the law, the Chamber of Notaries can claim for the deprivation of rights. There are approx. 6,000 public notaries in Russia. They all must be impartial and independent and they must equally represent both parties in situations of transactions, agreements and other contracts.
Admission
According to the law, a Russian public notary must have completed a higher education in law. Moreover, he must attend at least one year of practice under the supervision of an authorised public notary in Russia. Last but not least, a candidate for the profession of public notaries in Russia must pass the state examination in order to obtain the license issued by the Ministry of Justice. Only now, a Russian public notary is able to practise his legal profession.
Activities
A public notary in Russia has numerous legal duties, including certification of official documents, proving authenticity of contracts, holding documents for storage, taking testimony for court proceedings, issuing orders to confiscate goods or preparing documents of inheritance. Public notaries in Russia might as well take measures to protect a property inheritance, demonstrate fidelity copies of documents or translation of documents from one language to another, certify citizenship, accept deposits of money or instruments, provide evidence and perform all other kinds of acts that must meet the requirements of the Russian Law.
