Lawyer in Albania

November 13, 2011, 6:57 pm

The legal profession in Albania is regulated by Law 9109/2003, with recent amendments in Law 10047/2008. The profession of lawyers in Albania is independent and self-managed. The Albanian National Bar Association supervises the legal activity of attorneys in Albania and makes sure that lawyers in Albania do not disobey the rules in the Code of Ethics of the Advocate. Also, the National Chamber of Attorneys in Albania supervises the profession. The National Chamber of Attorneys in Albania is formed of local chambers that are set up in all administrative regions and are represented by lawyers of law offices in that specific territory. The Ministry of Justice also keeps an eye on the legal activity in Albania. A register of all the approximately 4,000 lawyers in Albania is kept with the National Chamber of Advocates and the Ministry of Justice.

Before becoming lawyers in Albania, candidates must register as assistant lawyers at the Albanian National Chamber of Advocacy. After graduating a law school with a law degree, the candidates must take a five-year period of training and pass the Bar examination before becoming fully entitled attorneys in Albania.

Forms of practice

An attorney in Albania can choose to practice the legal profession either individually or in a law firm in Albania. Albanian law firms choose their employees on the basis of their competence and task-fulfilling ability.

A lawyer in Albania can deal with many legal situations, such as company formation and operation, real estate purchase, registered offices provision or divorces. Drafting and implementing legal documents also falls under the duties of a lawyer in Albania, as well as the management of the client’s assets. Nevertheless, an Albanian attorney is able to offer legal advice in any other fields that the client needs support and may intervene for resolving conflicts between the parties.
